PARTICULAR CONDITIONS OF THE TRANS-FAST ONLINE SERVICE
Update January 2019.
General information.
In accordance with the provisions of current legal regulations provided in the Law 18/2018, of November 23, on payment services; the purpose is to establish the measures of transparency towards the Originator. These measures are presented below through the conditions of a general framework of rights and obligations assumed by the parties related to the use of the money transfer service in relation to online payment orders (hereinafter “TRANS FAST ONLINE” or “DMS”). The following Particular Conditions of the TRANS FAST ONLINE Service will be applicable to the service. In case of discrepancy, they will prevail over the General Conditions of the Entity.
Trans Fast Financial Services, LLC, EP, CIF: A-83085217 (hereinafter Trans Fast, EP or Entity) is a Payment Entity authorized by the Bank of Spain to provide the money transfer service. It is inscribed under registration No. 6813 through its Main Office located at Batalla del Salado street, 25 CP 28045 Madrid and through its Authorized Agents throughout the Spanish territory.
These documents will be available at all times inhard or durable copy in the main office and on the website www.transfast.com; as well as, in the Network of Authorized Agents of the Payment Institution. The ORIGINATOR has had access to them prior to contracting the Service.
The scope of application of these Particular Conditions is to regulate the conditions under which the ORIGINATOR may contract, order transactions, give instructions, check the status of their payment orders and, in general, communicate with Trans Fast, EP by telephone and Internet, through the identification and security system established by the Entity.
TRANS FAST ONLINE Service Concept (Formerly referred to as “DIRECT MONEY TRANSFER”):
It is a mechanism of payment in foreign currencies that the Payment Institution performs by electronic transfer of funds, on behalf of its ORIGINATORS and in favor of natural persons resident in other countries.
Main characteristics of the Service:

Fast and secure payment system.

Service with international coverage through correspondent banks.

Through this mechanism, international payments are made for family remittances.
-
It can be made in any internationally quotable currency.
Who the Service is for:
It is aimed at consumers and users, whether individuals or companies wishing to send money from Spain.
Requirements to qualify for the Service:
-
To be an ORIGINATOR linked to the services of Trans Fast, EP.
-
To become active through the web portal of Trans Fast, EP, filling in the requested information.

To make the first deposit by transfer from an open account of the payer in Spain or any country of the European Union or third parties equivalent to the account indicated by Trans Fast, EP.

To provide the Entity’s Legal Compliance Department with any request for documentation required to execute the payment order.

The delivery time of the consignment at destination ranges from: 2 business days, to 72 hours.

The following are not permitted: attempts to not complete the requested data, underage payers or ORIGINATORS who do not provide the requested documentation, nor those indicated in the Manual for the Prevention of Money Laundering.
1.- Recruitment of TRANS FAST ONLINE Services.
1.1.-The ORIGINATOR may make queries on the status of their payment order and operations through the web portal or the channel www.transfastonline.com available at any time; as well as, request any modification and cancellation of the operation.
1.2.- This service expresses the Particular Conditions of payment order services through the TRANS FAST ONLINE system, which may be contracted only by residents in Spain.
1.3.-In cases where any promotional service offered by the Entity through the channels made available by Trans Fast, EP is contracted and it previously requires the updating of any personal data of the ORIGINATOR, it will be necessary for the manifestation of will of the ORIGINATOR for both the initial registration of the TRANS FAST ONLINE service and for the face-to-face operations.
The initial application of the data of a new ORIGINATOR, that is, someone who has not previously operated with the Entity, will not imply the subscription of those promotional services that Trans Fast, EP offers at that time to its ORIGINATORS. The hiring of the promotional service will require: a) a manifestation of expressed will of the ORIGINATOR and b) that the ORIGINATOR meets the specific conditions established for the promotion.
In any case, the subscription of any promotional service offered by Trans Fast, EP will also be subject, once subscribed to the TRANS FAST ONLINE Service, to compliance with the general conditions of the Payment Institution.
2. Identification of the User of the TRANS FAST ONLINE Service.
The Service is nominative and non-transferable.
All ORIGINATORS new or existing, natural persons using the Trans Fast Services, EP, are required to provide, in the terms established by current legislation, a copy of their National Identity Document to the Payment Authority, or an equivalent in force at the time of establishing relations with the Entity. Whilst the functionality and availability to make payment orders will be conditioned in accordance with the internal policy on the prevention of money laundering and the financing of terrorism.
All those who appear as ORIGINATORS of Trans Fast Services, EP will jointly assume all rights and obligations derived from the performance of any of them. The ORIGINATOR may not authorize a third party (hereinafter, the “Authorized”) duly identified to make payment orders on behalf of the latter.
Trans Fast, EP will not ask for payment or receipt of their payment order once the invoice has been issued. And once the Ordering Identification Form has been completed it will not ask for data, information or personal documentation by any means, whether by telephone, by SMS, by e-mail or whatsapp.
3. Operation of the TRANS FAST ONLINE Service.
3.1. In order to be able to have TRANS FAST ONLINE Service and give any type of instruction, once the ORIGINATOR agrees to the Trans Fast Privacy Policies and General Conditions, EP will send an email with the corresponding elements of security for the ORIGINATOR to access the TRANS FAST ONLINE platform.
The security elements together with the Identity Document number, (ID, NIE or Passport) in their case (hereinafter “Accrediting Document”), and the telephone number will be essential to operate with Trans Fast, EP. The ORIGINATOR accepts the use of any type of keys for the authentication, as well as codes or security elements for the execution of the payment order provided by the Entity.
Trans Fast, EP may proceed to the revocation or cancellation of the security elements in case it has reasonable indications that they could have been compromised due to loss, misplacement, theft or unauthorized use of any item or instrument of payment or due to the incapacity of the ORIGINATOR. In order to increase the security of operations and payment orders, Trans Fast, EP may reject the execution of orders and instructions received by means not authorized by the Entity for normal operations (such as fax or email) or those that have not been validated with the corresponding security elements. This rejection will not imply in any case the assumption of any responsibility on the part of Trans Fast, EP.
Once the service registration process has been completed, and as an additional security measure to the user access credentials and personal password, Trans Fast, EP will provide the ORIGINATOR with the corresponding security elements, which is a one-use code automatically generated by the application that will arrive through sms message to the ORIGINATOR’s telephone number indicated in the registration of the service.
This one-time code sent through sms will occur when the ORIGINATOR:

Accesses to view or edit their personal data

Adds a new payee of the payment order
-
Validates the amount of the operation
-
Tries to access after 21 days of inactivity.
These security elements will be applied previous to validation in the amount of the payment order by the ORIGINATOR to continue with the process of issuing the payment.
Otherwise, once the maximum session time has elapsed in the TRANS FAST ONLINE application without obtaining the validation of the security elements, Trans Fast, EP will proceed to not execute the payment order, having to start the process again by the ORIGINATOR.
3.2. The ORIGINATOR expressly commits to not disclose or provide their security elements to other persons and to keep them in a safe place (which are provided by their Banking Entity as debit and/or credit cards). In case of loss or theft of the security elements, the ORIGINATOR must communicate it to Trans Fast, EP without undue delay. For these purposes, an undue delay will be considered to occur when the notification does not occur within 24 hours after the ORIGINATOR becomes aware of the occurrence of the aforementioned events.
As long as this communication is not made, the ORIGINATOR shall be responsible for any operation carried out with its security elements. This leaves Trans Fast, EP released from any liability that may arise as a result of the operations in which the number of the Accrediting Document and/or the corresponding security elements are indicated. In case of suspected compromise of any of their security elements, the ORIGINATOR must, in addition to communicating to Trans Fast, EP without undue delay, proceed to block and/or change their passwords.
3.3. Trans Fast, EP may limit, previous communication or by the Payment Institution’s policies, the amount per day and amounts of the payment orders made by the service.
3.4. Trans Fast, EP will not assume any responsibility for the performance of the media devices (telephone, email, Internet, etc.) other than Trans Fast, EP used by the ORIGINATOR.
Trans Fast, EP is not liable for damages that may arise for the COMPLAINERS or for third parties as a result of non-receipt or late receipt of communications for reasons attributable exclusively to those operators outside Trans Fast, EP used by the ORIGINATORS .
3.5.Trans Fast, EP will not be responsible for the non-execution or delay in the execution of any operations if such lack of execution or delay is a consequence of a case of force majeure, fortuitous event or, in general, any circumstance that occurs to the ORIGINATOR and in which Trans Fast, EP can not have direct control (such as power and/or telephone outages that affects the ORIGINATOR, computer viruses on their equipment, deficiencies in their telecommunications services or the compromise of the keys, security elements or identification).
3.6. Trans Fast, EP may provide information through its website that, in spite of being relevant, is not of personal nature for itsORIGINATORS.
3.7. Trans Fast, EP can not issue any payment instrument; therefore, the user exempts from responsibility that information through any of the means of communication that suggests that the Entity provides services other than the one that is legally submitted.
3.8. Trans Fast, EP urges users of the TRANS FAST ONLINE Service to use the payment instruments (debit and/or credit cards, ATMs and transfers) in accordance with the conditions that regulate their issuance and use according to the Banking Entity to which that payment instrument is linked. They must take all reasonable precautions to protect the personalized security elements that are provided. In cases of loss, theft or unauthorized use of any item or instrument of payment, the ORIGINATOR must notify it to Trans Fast and its corresponding Banking Entity, as soon as it has proof that these circumstances happened and without undue delay. For these general purposes, an undue delay shall be deemed to occur when the notification does not occur within 24 hours after the ORIGINATOR becomes aware of the occurrence of the aforementioned events.
Trans Fast, EP will not be responsible for any damage that may occur to the ORIGINATOR in case this notification does not occur or if it occurs with undue delay, as defined in the previous paragraph.
The ORIGINATOR, regarding an unauthorized payment transaction, will be subject to the responsibilities and obligations established in the General Conditions of the Entity provided that they have not been the result of a deliberate breach or gross negligence of the obligations established in this Contract, and in the regulations that are in effect for that purpose.
4. Deposit in cash, Transfers and other means of Payment.
Without prejudice to what has been established for each of the services provided by the Entity in its General Conditions and those described in these particular conditions, Trans Fast, EP may restrict the entry operations that have origin or destination in certain countries or for their consideration of tax haven or following the recommendations of the FATF International Financial Action Group or other national or international bodies or agencies, or in accordance with internal policies of Trans Fast, EP.
Required policy to apply to the TRANS FAST ONLINE service for both New and Existing COMPANIES who have placed payment orders in person.
a) Through contribution of funds through a cash deposit account (ATMs or Banking Entity) of Trans Fast, EP (only those indicated by Trans Fast, EP at the time of executing the operation, or through telephone confirmation for the area of attention to the ORIGINATOR of the Entity), opened in a bank branch in Spain.
Trans Fast, EP will not use any means of communication to spread and invoke or motivate to make unauthorized income in their accounts opened in Spain or in another country.
b) Through Debit or Credit Cards (ATMs or the Trans Fast web portal, EP TRANS FAST ONLINE service). At the time of carrying out the operation, the ORIGINATOR must enter as a security element a one-time use code provided by the Entity to validate the execution of the payment order, as indicated in section 3, numeral 3.1 of these Conditions.
The means of payment through Debit or Credit Cards will be made by using the virtual POS service contracted with a payment means provider (hereinafter “Banking Entity”) taking into account the necessary security precautions that guarantee the service user the application. Notwithstanding the provisions of point 3 of these Conditions.
Once validated by Trans Fast, EP, the ORIGINATOR will continue the execution of the operation including the debit or credit card details of its issuing Banking Entity, in which it will have to apply a one-time code through the security elements that their Bank has assigned to it to authenticate the operation. These can be their coordinate card, pin or any other code or key.
c) By bank transfer from the open account of the ORIGINATOR to the Trans Fast account, EP.
Funds from contributions made through any of these means of payment, once it becomes effective in the bank account of Trans Fast, EP, will guarantee its delivery to the destination and will be delivered in its full to the Beneficiary in accordance with the terms indicated in Point 5 and in accordance with the current General Conditions.
Trans Fast, EP reserves the right to totally or partially cancel the firm payments of the aforementioned operations, provided that the operation meets the risk criteria of the Entity.
5.- Delivery Deadlines through the TRANS FAST ONLINE Service.
The delivery time of the payment order at destination will vary between: 2 business days to 72 hours (all days of the year except Sundays and international, national, autonomous or local holidays). In the event that the ORIGINATOR has applied to make the payment order and has not made the deposit or transfer in the account of Trans Fast, EP in the course of 24 to 48 hours on business days, the order will be eliminated without prior consent or withdrawal by the payer due to fluctuations in exchange rates. Therefore, you must manage this operation again.
5.1) Payment operations executed incorrectly.
When the ordering party has knowledge that a payment transaction has been incorrectly executed, it must communicate it to Trans Fast, EP without undue delay, in order to be able to rectify the omission or the error committed. If it is impossible to rectify the error and it is attributable to Trans Fast, EP, the Entity will return to the Originator the amount of the money order.
On the other hand, if the error is attributable to the Originator, it will be incumbent on them to assume the incident generated by the data erroneously provided by the sending of the payment order, therefore, the amount will not be refunded as a commission; and in the case of requesting its return, the Return Policy of the Entity will be in accordance with the established form and deadlines.
It will be understood that in case of an execution of a new payment order for error or omission of data from the beneficiary by the Originator, the delivery time to the beneficiary will start from this new order authorized as indicated in section 4.
5.2) Non-execution or defective execution of a money transfer operation carried out.
Trans Fast, EP, will be liable to the Originator for the correct execution of the money transfer operation, until the moment the amount is paid to the beneficiary.
In the case of payment transactions, the responsibility of Trans Fast, EP will be extended until the amount of the money remittance order is paid into the correspondent’s account of payment services of the beneficiary. Once this payment is made, the beneficiary’s payment services correspondent will be responsible to the beneficiary for the correct execution of the operation.
In the case of payment transactions not executed or executed defectively, when the Entity is liable to the Originator, it will return the amount corresponding to the transaction to the Originator without undue delay, in accordance with the terms established in the Return Policy of the Payment Institution.
When the person responsible in accordance with the provisions of the preceding paragraph is the beneficiary’s payment services correspondent, the beneficiary shall immediately make available the amount corresponding to the payment transaction to the beneficiary.
In any case, Trans Fast, EP will try to find out immediately, on request and independently of its responsibility, the data related to the payment transaction and will notify the Originator about the results.
6.- Return or refund policy through the TRANS FAST ONLINE Service.
The Paying Party Originator will request the elimination or cancellation through the main office of the Network of Agents; as well as, those that operate through the platform of TRANS FAST ONLINE.
The refund of the amount of the payment order to the Originator, will occur in case the fault is not attributable to Trans Fast, EP. The net amount will be refunded, without commission and expenses paid in relation to it, when there is: a) Impossibility of delivery of the transfer, due to error or omission in the identification data of the beneficiary provided by the Originator of the service. b) the identification presented by the Originator is not valid, including option c) that the beneficiary does not withdraw the transfer.
In cases where the causes were attributable to Trans Fast, EP the Paying Party Originator has the right to request a total refund, including expenses and commissions, on an executed operation.
At the request of Trans Fast, EP, the Originator will be responsible to demonstrate that such conditions are met when the following occurs: i) The shipment did not specify the exact amount of the transaction; ii) That the amount of the transaction exceeds the amount that the payer could reasonably expect considering the previous spending guidelines, these general conditions and the circumstances relevant to the case.
In the event that the Payment Service Originator requests to process the elimination or cancellation through the TRANS FAST ONLINE Service: (Non-Presential Transactions)
They will be able to register the request on theIncident access section of the TRANS FAST ONLINE service website, where the Entity Customer Service will contact the Originator by telephone.
At all times they will be able to attend to the main office of the Entity, at the address indicated in point 7 of the Conditions or through the Network of Authorized Agents where they can fill out the cancellation form and start the process.
For both cases, the Entity must complete and process the cancellation and reimbursement within 72 hours (business days) from the request of the elimination/cancellation. If necessary it will discount the service charges for the concept of commission.
The Originator may not invoke reasons related to the exchange of currency when the exchange rate of reference applied was visible for informative purposes prior to the acceptance of the order shipment, or through the TRANS FAST ONLINE portal or in the Web of the Entity where it indicates “Change of the day”, according to the particular conditions of the TRANS FAST ONLINE service.
In any of the cases indicated above, the Entity will contact the Service Originator to proceed with the corresponding refund or reimbursement; according to the indications expressed in this policy that indicates payment method, type and time of reimbursement.
The means of payment used for the execution of the refund or return will be through the same means that the operation was performed. As established in the Single Annex of the Return Policy of the Payment Institution.
If the Originator is not satisfied with the service provided, they can submit their complaint or claim, since the Entity has a Customer Service Area for the attention and resolution of queries, complaints and claims submitted by its Applicants, in relation to their legally recognized interests and rights. The data is presented in section 7.
Trans Fast, EP may reject the execution of an order for sending or payment of money, when the payer or beneficiary refuses to provide any information or documentation required in the General Conditions, or in application of the internal policy on the Prevention of Money Laundering. Trans Fast, EP will notify the Ordering Party of the rejection and, as far as possible, the reasons for therejection, as well as what must be done to rectify possible errors or omissions that motivated it.
The Return Policy is also expressed in the General Service Conditions.
7.- Duration, cancellation and withdrawal of the Contract.
7.1.-The present Particular Conditions will have an indefinite duration, from the moment of its acceptance, remaining in force while the ORIGINATOR keeps any Tran Fast Service active.
7.2.- The TRANS FAST ONLINE Service may be canceled at any time by the ORIGINATOR by sending an email to sac@transfastspain.com.
7.3.- Trans Fast, EP may resolve the contract immediately, in cases of default by one of the parties (especially when false data or manipulated documents have been provided and when there are indications of fraud or money laundering) or in situations in which there are serious reasons that alter the circumstances that led to the celebration of this Service.
7.4.- Trans Fast, EP reserves the right to consider inactive the TRANS FAST ONLINE service in case no payment order has been produced for a minimum period of one year, thus Trans Fast, EP will consider that ORIGINATOR inactive.
Notwithstanding the foregoing, the ORIGINATOR shall have the right at any time to expressly request Trans Fast, EP to exercise their right to cancel their personal data product of the TRANS FAST ONLINE service.
7.5.- In the Particular Conditions of the service, it will be expressly established if the right of withdrawal is applicable, the exercise of which, whatever the case may be, will be carried out as indicated in clause 9. This right will be applicable exclusively to the ORIGINATOR who is considered a Consumer .
8.-Protection of the funds of the Paying Service Operators:
The Entity will protect the funds of payment services received from the Originators which are subject to the procedure set forth in article 21.1, paragraph a), of Law 18/2018, of November 23, on Payment services. Therefore, the funds received from the Originators will not be mixed at any time with the funds of any individual or legal entity that is not Payment Service Operators in whose name the funds are available and, in case they are still in possession of the Entity and have not yet been delivered to the beneficiary or transferred to the Correspondent at the end of the business day following the day in which the funds were received, will be kept in the open deposit account that works as the guarantor of the funds and which is detailed below:

In this case, the holders of the funds will enjoy the right of separation on the account mentioned in the preceding paragraph, in accordance with the regulations in force, for the benefit of the Paying Service Originators, regarding possible claims of other Trans Fast creditors, particularly in case of insolvency.
9.- SERVICE DEPARTMENT OF CUSTOMER SERVICE.
As indicated in the General Service Conditions. In case of any query, complaint or claim of any kind with the service, the Originator may write it and contact any of the offices of the Network of Authorized Agents or the Customer Service Department (SAC) of Trans-Fast, EP through the following means:

In cases where the CLIENT wishes to make a claim for the service provided and has provided all the necessary data to make their claim, TransFast, E.P. will resolve it no later than fifteen (15) business days after receipt of the claim.
In exceptional situations, if a response can not be offered within fifteen (15) business days for reasons beyond the control of Trans Fast, EP, the latter must send a provisional response, stating clearly the reasons for the delay of the answer to the claim and specify the period in which the Originator of the payment services will receive the definitive answer. In any case, the deadline for receiving the definitive answer will not exceed one (01) month.
Right of withdrawal:
It will be expressly established if the right of withdrawal is applicable, the exercise of which, whatever the case may be, will be carried out as indicated in this clause. This right shall be applicable exclusively to the Originator (client) who is considered a Consumer.
For the Trans Fast On Line System Service Provider, they will have a period of fourteen calendar days, starting from the day of the contracting date, to be able to desist from the service without needing to indicate the reasons and without any penalty, revoking therefore the consent granted in the formalization.
The Originator who wishes to exercise the right of withdrawal must, before the end of the term, send a certified letter via email with acknowledgment of receipt to the Customer Service Department at the address previously provided.
In the second instance, in order to present the claim or complaint it is necessary to have previously addressed Trans Fast, EP., proving to have obtained an answer on the controversy or, otherwise, the course of one (01) month without answer (if you are a client ), or (02) two months (if you are not)

To carry out the process electronically, it will be necessary for the interested party to have a valid digital certificate accepted by the Bank of Spain.
Term Resolution:

Consumer Claims: 90 days since the file is completed.

Claims of non-consumers: four months from the presentation.
-
Consultations: one month from the presentation.
10.- Resolution of online litigation in consumer matters: (known as “ODR Regulation”)
The Originator of the money transfer service has the possibility of an alternative resolution of litigation as a result of a claim for the service provided.
For this, certain requirements must be met:
1. The parties may submit their claims, as well as how much documentation is necessary, online or not. In case the use of electronic means by the parties is not possible, the Bank of Spain must allow its presentation by any other means that allows the identification of the claimant.
2. When the Bank of Spain before which a claim has been submitted receives all the documentation with the pertinent information in relation to it, after rectification in its case, it will immediately notify the parties and indicate for any medium that allows to have proof of this, the date in which the complete reception has taken place.
Duration of the procedure:
The result of the procedure must be disclosed to the parties within a maximum period of ninety (90) calendar days from the date of submission of the claim or, as the case may be, from the date on which the durable has received the complete and necessary documentation for the procedure.
The European Consumer Center and public administrations with competence in the field of consumer protection will provide links between their websites and the website or websites of the European Commission containing the consolidated list of entities accredited and notified by the different Member states.

Purpose of the Treatment: generation and processing of the commercial invoices of the company, claim management of collections, Legitimization of the Treatment.
Arts. 29.2. e) Law 58/2003, 164.One. 3º Law 37/1992, 2 RD 1496/2003; as well as arts. 4, 5, 6, 7 and 12 of Law 10/2010. In case of not providing the necessary data for the purposes of the treatment, administrative management will not be possible. The data will be kept for the duration of the contractual relationship with the Originator and in case of withdrawal, the minimum period indicated by the current legal regulations.
Recipients of Cessions or Transfers. Data transfers will not occur except those covered by the current data protection regulations. Data conservation dates. These data will be kept for the time required for its function or as much as the corresponding tax legislation indicates. Exercise of Rights. Interested parties may exercise the rights of Access, Rectification, Deletion and Portability of the data provided and limitation or opposition to the processing through a written document, accompanied by an identification document in force, before TRANSFAST FINANCIAL SERVICES SA – Dept. of Administration.

Interested parties have the right to withdraw their consent.
Interested parties have the right to complain to the Control Authority (www.agpd.es).
Trans Fast E.P. reserves the right to adopt all the rules and security measures it deems appropriate to guarantee the proper use and confidentiality of the service.
The Originator authorizes Trans Fast E.P. not to execute the orders received when the identification of the payer and/or beneficiary, data or amount of the payment order are not correct and/or have reasonable doubts about the identity of the person issuing the orders in question.
Trans Fast will inform the payer that the conversations derived from the service of the Payment Institution may be recorded, and/or all the communications and transactions that are maintained due to the use of the Remote Services may be registered.
The Originator may obtain a copy of the content of the communications for free, however, the Originator may demand that the procedure be carried out through a medium different from that the one used by Trans Fast, EP; however, the disproportionate costs resulting from their choice will be borne by the Originator.
12.- Resolution. Applicable law and jurisdiction.
These Particular Conditions will be governed by Spanish legislation. Any dispute will be resolved before the courts or tribunals that correspond to the autonomous communities of Spain.
SINGLE ANNEX RETURN POLICY.
The Entity must complete and process the cancellation and reimbursement within 72 hours (business days every day of the year except Sundays and international, national, autonomous or local holidays), from the request of the elimination/cancellation. It will discount, if necessary, the service charges for administrative expenses incurred.
If the ORIGINATOR is not satisfied with the service provided, they may can their complaint or claim. The Entity has an Attention Service Area for the ORIGINATOR which is aimed to the attention and resolution of the complaints and claims presented by its ORIGINATORS, in relationship with their legally recognized interests and rights.

* This period takes into account the processing of reimbursement by the Correspondent (Payer); which can be between 2 and 3 business days (every day of the year except Sundays and international, national, autonomous or local holidays)
